This thesis is mainly about the creative treason of literary translation from the translator's subjectivity, and deepening this bran-new conception further in the translation field.The relationship among author, original works, translator, translated works and readers is discussed, from which the translator's subjectivity and the creative treason of literary translation are studied in the thesis. Furthermore, the creative treason bears on the reception contexts as well.The establishment of translator's subjectivity is experiencing a long time. In the traditional translation viewpoints, the translators were always regarded as "servant" and demanded honesty to the author and readers as well as "being invisible". However, owing to the differences between language and culture, the limitations of translation and the instability of meanings, it is difficult for the translators to be honest completely to the original works which impels the translation study turns to the translator's subjectivity. The Hermeneutics is the earliest theory which focuses on the subject study.Translating is an understanding and interpreting process in the light of modern Hermeneutics. The translator, first, is a reader and interpreter, has his own "pre-construction" and "fore understanding", whose understanding and interpreting is active and affected by the language and culture, unique. Hereby, there isn't absolutely impersonal translated works which is honest to the original works. The translation study is turning its steps to the most active element-translators.The main representations of translator's subjectivity (i.e. the creative treason of literary translation) are individualized translation, translation errors and missing,abridged and edited translation, indirect and adapted translation.The creative treason of literary translation is affected by the readers and reception contexts besides the translator. A work can't be seen as a literature without the readers. The translated works will be distorted unavoidably in the readers' reading and receiving process which is a kind of creative treason in a certain extent. Consequently, it appears different translated works of the same original in the same time and accepted by different readers. The range of the creative treason in a certain degree is enlarged.The language and style of a translated work will change with the time affected by the political and economic elements, although the letters and contents of the original stay unchanged. The original works maybe unknown in their country, while their translated works are gone over big in the target country, which is the creative treason by the reception contexts.A good translated work is equivalent to writing, sometimes even exceeds the original one, which fuses with the translator's subjectivity, has large impacts on the linguistic and culture construction of the target language. Therefore it should be recognized as one form of literary works, no other than can the translators deserve their positions in the translation activities.
