The legislation of morals, namely, the lawmakers make some moral concepts, moral criterions and moral principles embodied by law on the basis of the society's development and in virtue of lawmaking procedure. Finiteness and process are the characteristics of the legislation of morals. The coherence of morals' and law's value tropism and adjusting & controlling objectives provides the legislation of morals the basic foundation. Meanwhile, the sameness of the two items' regulating methods and the consistency of the two items' regulating range provide the legislation of morals realistic space. Moreover, the legislation of morals is the external requirement of conquering the natural weakness of morals, the inevitable requirement of the realization of law and the development of socialistic market economics. During the practice of lawmaking, the legislation of morals is mainly embodied in the following approaches, transforming the concepts of morals to the concepts of law, transforming the morals' criterion or principles to the criterion of law and the morals' criterion or principles to the principles of law. Due to the legislation of morals is the course of lawmakers selecting some morals and transforming them to law, the lawmakers have to follow the five fundamentals, namely, the requirement of society, validity, maneuverability, basic morals and advocating gracious morals when they decide which morals should be made into law and which morals should be remained into the field of morals.
