Research On The "Factory Law" Of Nanjing National Government (1927-1937)

Soon after the foundation of Nanjing National Government, in 1929, the Kuomintang published the "Factory Law", resulting from on one hand, an increasing attention given by the International Labour Union, in terms of china' s labour problem and on the other hand, the governs aim to consolidate its ruling order and develop its capitalist economy. The law, comprehensive and complete, occupies a significant position in the history of legislation of modern China. It, therefore, is of much meaningfulness to have an investigation of the law' s implementation as well as the subsequent influence upon the then society so that we are able to draw what today' s socialist market economy can takes as reference.This article is made up of 5 parts.Introduction is an illustration of the basis upon which the subject is settled, the literature review, the problem to be discussed and the researching methods.Chapter One :analyses the domestic and international back ground behind the "Factory Law" , it also expends the legal basis , the guiding ideology and principles , and the implementation of the "Factory Law" by the Nanjing National GovernmentChapter Two: examines the legislations and clauses of the "Factory Law" , giving at the same time a particular importance to the contrasting of the "Factory Law" against after laws, of the same or previous period. The purpose is to clarify its advantages and disadvantages. Finally, we try to find out the reason why the "Factory Law" is repeatedly postponed and amended.Chapter Three is devoted to the objective observation ofthe implementation of the "Factory Law" , effectiveness, and the factory' s conditioning its implementation.In conclusion, a brief summary is given, in addition to an overall evaluation of the "Factory Law" by the Nanjing National Government . It is pointed out that the present study is enlightening and inspiring when it comes to the settling of the labour disputes under the socialist market economy, and the building of our legal system and law enforcement system.
