On Formal Non-equivalence In C-E Legal Documents And Its Translation

Scholars at home and abroad have been conducting an active and effective research towards legal translation. This dissertation attempts to probe into legal translation from the aspect of formal non-equivalence. Translation consists in reproducing in the receptor language the closest natural equivalent of the source language message (Nida). During C-E legal translation, such an absolute equivalent doesn't exist. In this dissertation, the author attempts to reconfirm that a legal document translator's role has changed from a pure translator into a rewriter and co-drafter of SLT by introducing transfer mechanism, nature of translating and changing role of a translator in her dissertation, with the hope to contribute her shares to the development of study on legal translation theory and practice. The author, by putting forward a lot of formal non-equivalence facts between Chinese and English legal documents mainly in terms of lexical and syntactic levels, attempts to confirm the dynamic equivalence effect in the field of E-C legal document translation. This thesis can be divided into six parts.In Chapter I, the author makes a literature review of equivalence and equivalence effect theory in the translation field at home and abroad, and then she introduces the concept of equivalence as well. In Chapter II, the author researches into the problem of formal non-equivalence. The author puts forward noticeable features of legal Chinese and English languages at word and syntactic levels. In Chapter III, the author deals with the role of a translator. The author mentions that the translator has changed from a pure translator into a text producer as well as a co-drafter from the aspect of the transfer mechanism of translation.
