Protection Of Cultural Heritage By Law

With the concept of coordinated development of material and spiritual civilization, at present, culture industry, especially the cultural heritage industry is economic focus in our country. In the progress of Chinese rapid development of economy and urban modernization, cultural heritage resources are massively exploited. Plenty of cultural heritage resources, with high historical value, scientific value, cultural and artistic value and economic value, are utilized by commercial motive, for example, constructions of attraction, performances of customs and culture, and loss and damage of heritage. Cultural heritage promote the economic development, at the same time, they are seriously threatened. Under the background of development of socialist culture industry, how to use and protect cultural heritage is our topics and responsibilities. With scientific development concept, ecological economy and green industry, we find the direction and development path. Therefore, we must reasonably use and protect cultural heritage, under the guide of the view of sustainable development and the Legal norms. And we should make sure that the economic development and cultural heritage protection is unified and harmony. Under this background, based on the present situation of protecting cultural heritage in our country, this paper cites orther countries'experience and measures, explores a useful legislation model to protect our country's cultural heritage, and give a good idea to the protecting work.Except the introduction, this thesis is composed of five sections.Section one, the author define the main content of the discipline theory of cultural heritage and its legal protection, sum up the characteristics of cultural heritage, analysis its legal relation, and introduce the protection status of cultural heritage in the world. Section two, describe the current protection status of cultural heritage in China, and classify related systems and methods. So we can achieve a combination between phenomena and systems. Section three, according to the domestic situation about protection, the author point out that there are some problems in the progress of our cultural heritage protection, and analysis the reasons why these problems happen. Hope that we can do it well. Section four, from two aspects including the legal system and organization, research and analysis the legal protection system of cultural heritage about Japan, America and France. Sum up these countries' successful experiences. Section five, learning from other countries'experiences and basing on the specific conditions in our country, the author propose advices and attempt to build a legal system to protect the cultural heritage, from four aspects including protection view, legislation, management structure and education by the law.
