The intangible cultural heritage is the common wisdom of human being, in which the nations spirits could be seen obviously. The intangible cultural heritage is the manifestation of various national character and soul. The intangible cultural heritage has very important significance in the fields of developing the creativity of human being, protection cultural diversity, promotion of sustainable development of human society and so on. Frequent in today's economic crisis, how to solve the crisis of human spirit and thus better solve the endless problems of human society, the intangible cultural heritage is undoubtedly of great value and function, its deep-seated values urgently need further study. How to build an effective legal mechanisms in the protection of intangible culutral heritage, and how to build a corresponding system of rules in order to achieve the goals of the protection of human cultural diversity, academics, practitioners are conducting lively discussions at home and abroad recent years. The intangible cultural heritage in China is a relatively new legal concept. It is still in its early stages in the legal protection of intangible cultural heritage. Academics are still actively seeking appropriate legal methods and protection modes.In this article, chapter one is the concept of intangible cultural heritage, which defined it from the connotation and extension. Then it discusses several major features of intangible cultural heritage, and it also has a few of distinctions between the concept of cultural heritage so we can learn the object of study,"intangible cultural heritage" specifically in this paper. The second chapter discusses the international protection of intangible cultural heritage which related to the basic legal issues. Begins by describing the international protection of intangible culutral heritage, then describes the protection of intangible cultural heritage in international law and the concept of flow changes, as well as the basic principles of international protection. Finally it is about several specific concepts, such as the intangible cultural heritage subjects of rights, the rights of the content of intangible cultural heritage and protection obligations and so on.In the third chapter, it lists several key ways in current international law on the protection of intangible cultural heritage, such as the law of international human rights, international environmental law, intellectual property law and so on. Using comparative method, Chapter IV describes the international community which had an early start and which has a more mature legal system in protection of intangible cultural heritage, such as Japan, South Korea, France, Taiwan and other countries. Next Chapter V describes the current protection situation of China's intangible cultural heritage. Chapter VI is the conclusion of this article. Through a series of presentations, comparison and verification, the author attempts to give some suggestions and ideas in building a legal systems in protecting intangible cultural heritage in China.
