Research On The Protection By Criminal Law Of Non-state-owned Enterprise's Rights And Interests

Non-state-owned enterprise plays an important role in our development of economy. Protect of its rights and interests has great impact in the positive of holders and managers, and the continious,fair,high-speed development. Criminal law as the most severe punishment should have its own effect. So it has both theory and practice meaning to study the crimiral protect of the rights and interests of non-state -owned enterprise.First of all, the article interprects ground comcepts such as"non-state-owned enterprise"and "the rights ant intersts of enterprise"and so on.On this ground, it analyzes the present situation of the criminal protect on state-owned enterprise,and points out that we have given a certain but not enough protect of non-state-owned enterprise.Secondly, the article elucidates the necessarity of strengthen the protect of the rights and interests of non-state-owned enterprise which would neither lead to avianizement of state-owned-enterprise and comparsion of criminal penalty, nor break the principle of criminal law being Utima Ratio and decriminalization.At last, the article points out that we should perfect our Criminal Law and the legislative model of accessory criminal law to strengthen the protect on the rights and interests of non-state-owned enterprise.
