The thesis puts forwards the necessity of applying the joint venture in project contracting after analyzing the effect on the domestic and international construction markets of China with its entry of WTO, comparing the advantages and disadvantages of Chinese and foreign construction enterprises and describing the development of bigger scale, more specialties involved and higher standards in construction contracting market. And in the thesis the author analyzes the concept, nature, characters of law, litigants, characteristics and types of construction contracting joint venture and compares it with the subcontracting and enterprise group separately. Then the paper studies the theory bases of the joint venture formation from the aspects of Transaction Cost and Asset Mutual Compensation Theories, the coexistence economy effect and the cooperation models of joint venture. Furthermore the paper studies the core parts of joint venture implementation such as reasons, principles, partner selection, type selection, contract and organization and puts forwards certain standards, principles and steps for the establishment of joint venture. After exposing the internal relations of competition and cooperation between the parties of the joint venture the author studies the management of joint venture from the aspects of maintaining trust, creating culture of joint venture and managing the human resource. Finally the author proposes the strategies of Chinese construction enterprises' implementing joint venture and gives beneficial ideas about the application of project contracting joint venture.
