Research On The Judge Committee System

Judge Committee System is the important component of our country抯 justice system. Studying and researching the history, the current situation and the future of it will benefit evaluating the current justivce system of our country, benefit promoting the justice reforming and benefit constructing just, independent, efficient, and democratic socialistic justice system.Though several researchersm, judges and lawyers have done a lot of probement of it, much of it lacks needy objectiveness and systematic property, and also lacks the supervising of the true theory of knowledge. In this paper, author brings up that the Judge Committee System, especially, the system of deciding the case through discussing, is set up on the basis of subjective idealism, and denies the 搒ubstantial judge power?of it. Besides, the author objectively expounds its history and the reasons of its existing for so long time, and evaluates the relationship between it and justice fairness, justice independence, and justice economy, then constructively proposes several substantial proposals of reforming it. Author also believes that the reforming of it shonld observe some rules to make the reforming justilization and regulazation. Besides, we should do the correspondent justice reform, for example, to better the judges?ability, to perfect the judge duty system, etc. otherwise, it will be difficult to realize the reforming goals of it.
