Study On The Procedure Of Limitation Of Liability For Maritime Claim

The procedure of limitation of liability for maritime claims is a legal procedure to protecting the legal rights of the person liable. Proving the procedure of limitation of liability for maritime claims is a better way to protect the benefits of the person liable. In chapter X, "Marine Procedure Law" has provided the procedure for the person to constitute the limitation fund. From the analysis to the procedure of limitation of liability for maritime claims, the writer raised the own opinion and suggestion. Meanwhile, from the analysis to the limitation of liability for maritime claims and limitation fund, the writer draw the conclusion that the necessity to found the procedure of limitation of liability for maritime claims. After the study on the concrete part of the procedure, such as the jurisdiction, the party concerned, limitation fund, and the other things, the writer put forward some legal suggestion.
