Protection Afforded To Copyright About The Internet

The Internet has swept the world in scores of years, becoming a global mass medium integrating technologies of communication and computer. The infinite reproduction and unpredictable reciprocity have shocked the system of copyright protection .The hundreds of years history of copyright system is actually the history of technological development. There is a delicate reciprocal relation between the technological advancement and the development of copyright protection.The copyright system in cyber environment is facing the challenge of how to realize its social function, that is, to let the general public make full use of the human being's intellectual treasures on the premise of protecting the copyright owner legitimate interests, in other words, to reach a balance of interests between the two sides.The research into copyright is still in its infant stage in our country, leaving many areas to be developed and many gaps to be filled. Especially at the moment of china's accession to WTO, our country's must be amended to gear to international conventions. In view of this starting point, the thesis will discuss about the challenges the copyright system has to face from the internet technology and expound the vitality of the traditional copyright law and its change in the information age.The thesis contains four chapters altogether. First it analyzes the three elements of copyright law in the cyber environment-the subject, the object and the new issues about the contents of rights. Then it concentrates on the influence of the internet on the copyright system in our country and the counter-measures.In the first chapter, the issue of the copyright subjects in the cyber environment will be discussed. Compared with the traditional subject-theauthor and the related rights owner, some new concepts have appeared in the cyberspace such as "computer author", "ISP", "subject of investment" and so on .Whether these new members can become the subjects of the copyright will be analyzed and expounded in this chapter.In the second chapter, the new object of the world wide web-the protection of the special right concerning the multimedia and the data base will be discussed. The major areas of discussion are the ownership of multimedia copyright, management and whether to give independent right to the data base owner.In the third chapter, the concrete contents of copyright in the cyber environment will be interpreted anew. It is the focal point of both this thesis and every individual country's adjustment.The fourth chapter is the intention of this thesis, discussing about the influence the Internet has extended on the copyright and its significance to our country, which is the focus of the current amendment to our coimtry's.Limited by time and ability, the thesis is capable of errors, so criticism and correction are sincerely expected.
