The Innovative Impact Of Internet Piracy And The Digital Copyright Protection System

In the digital economy,digital copyright products have become an important product of digital innovation,and the digital copyright industry has become the core pillar of promoting the revitalization of my country’s copyright industry.However,digital copyright products have the characteristics of low marginal cost、intangibility and easy spread,leading to serious piracy and infringement.Digital piracy in the network environment has a strong network effect and how its existence will affect copyright innovation incentives and society has become a problem for many scholars.At the same time,the emergence of digital copyright has changed the business model of the traditional copyright industry,a new business model of "content + platform +terminal + terminal" has emerged,which has also brought unprecedented challenges to copyright supervision and protection.For the development of the digital copyright industry,whether the government needs to strengthen copyright protection and how to optimize the copyright protection model is of research significance.The biggest difference between online piracy and traditional piracy is the strong network effect and its impact on innovation may be quite different.Therefore,the protection mode of digital copyright can’t follow the traditional copyright protection mode.This article integrates copyright economics,platform economics,regulatory economics and other theories to study the innovative impact of online piracy and the optimal digital copyright protection model.The basic idea is to analyze the nature of digital copyright and new business models to make it more reasonable.The method of constructing a piracy infringement model studied the impact of online piracy on innovation,then empirically analyzed the impact of copyright protection on the development of the digital copyright industry and proposed a new model of digital copyright protection.The research focus of this article is:First,the impact of online piracy on innovation.In order to study the influence of network piracy with strong network effects on copyright innovation,this paper constructs a model and considers the two cases of no network effect and network effect.Through the comparison and analysis of the model,it is found that: when there is no network effect,network piracy will reduce the overall profits of genuine manufacturers,thus hindering copyright innovation incentives;when network effects exist,pirated products have a two-dimensional effect on copyright innovation,the impact is mainly determined by the cost of consumers obtaining pirated copies.Therefore,the government’s supervision of online piracy should be targeted and flexible.Second,the test of the intensity of copyright protection on the development of the digital copyright industry.This article first builds a copyright protection intensity measurement system from the two aspects of legislative intensity and law enforcement intensity,collects panel data from 30 provinces and cities and calculates the intensity of copyright protection in each areas,then uses copyright protection intensity as a core explanatory variable to build a measurement model for regression analysis.The results show that the overall copyright protection intensity(arithmetic average of 30 provinces)in China has shown a steady increase in recent years and the intensity of copyright protection has a significant positive correlation with the development of the digital copyright industry and an increase in the intensity of copyright protection will promote the development of the digital copyright industry.Third,analyze and demonstrate the "platform + government" dual-subject digital copyright protection model.This article compares the government copyright supervision model with the platform copyright supervision model and finds that platform copyright supervision has more information and technical advantages,but platform supervision has moral hazard issues.Therefore,this article believes that the two copyright supervision modes should be combined to build a "government + platform" dual-subject copyright protection system,strengthen the government’s responsibility for guidance and platform supervision.Finally,policy recommendations for digital copyright protection.This article puts forward the following main policy recommendations: First,the government’s supervision of online piracy should be targeted and flexible.Second,continue to strengthen the intensity of copyright protection and coordinate with other policies to promote the innovative development of digital copyright.Third,build a "government +platform" dual-subject copyright protection system,and strengthen the government’s responsibility for guiding and platform supervision.
