Research On Chinese Land Banking Institution

More than one thousand distinguishing government organs of land purchase and reserve have been set up hi all the country since the appearance of the organs of land banking in China. This brings forth good society effect and economic effect. The newly appearing things have large life force, but they also have many drawbacks and problems. So is the institution of land banking. Nowadays the organs of land banking in many cities are all founded after the investigation to the organs of Shanghai or Hangzhou. Their management institutions all imitate the Shanghai Model that is market-oriented, or the Hangzhou Model that is administration-oriented. And their institutions lack their native features, let alone the guidance of systematic theory. Furthermore, both the Shanghai Model and the Hangzhou Model have some defects. So it is necessary to study the institution of land banking under no guidance of perfect theories and no references of successful experience. Only by this can we carry out land reserve further, solve every problems in the operation better, and provide both systematic theory guidance and scientific basis for the operation. This thesis is written just for this purpose.This thesis expounds the realistic founding reasons and operation model of the institution of land banking in our country. Then the thesis analyses the existing problems. Finally on the above basis, it put forward the tentative ideas in order to perfect the institution of land banking in China.Firstly, the thesis generally explains the institution of land banking and expounds its three theories basis that includes the market-not-work theory, government economics theory and new institution economics theory. Secondly, the thesis discusses the realistic founding reasons from the purpose and the importance of setting up the Chinese institution of the land banking. At the same time, the thesis introduces the operation model of the institution from the range and source ofpurchased land, the main principles and categories of land banking, and the general procedure of land provision.Thirdly, the thesis minutely discusses the existing problems hi Chinese institution from the following aspects: the erection of the law and legislation, the raising and management of fund, the function fixation of land reserve and operation model.Lastly, on the basis of the above analysis, the thesis puts forward the tentative ideas of perfecting the institution of land banking, which includes perfecting the erection of the law and legislation concerned, withholding market operation and so on. And the thesis also argues that the government-oriented model should been chosen in the land banking.
