BOT investment method is a new method which rose in the 1980s, using international private capital to make investment on infrastructure project . It receive great attention of various countries and is widely used in Activities of international economy and trade.This article deals with the study of BOT method and China' legislative sistuation, mainly on the basis of relevant infernational investment and finance theory, and integrating with development history of BOT method and its practical operation. It also points out the legal problems encountered and possibly encountered of the operation of BOT method in China, makes a systematic discussion of the whole process of BOT method operation, and proposes unique opinions on the nature of BOT method.
