On Reconstruction Of Investment Rules For Foreign Capital In China

China has come to be one of the most successful countries in attracting foreign investment and has called international attention after more than 20 years' reform and opening. With the development of foreign direct investment,China has made a serices of laws,rules,policies and measures for foreign capital. China has also supplied favorable measures for foreign capital enterprises to attract foreign capital. Those favorable treatments are separate in laws constituted by National People's Congress and its Standing Committee,national or regional rules issued by State Department and ministries and commissions,and some more favorable ones in local rules and local favorable policies. It proves these favorable treatments have taken a significant role in foreign investment. The foreign investment enterprises,who enjoy all kinds of preference and suffer much restriction at the same time,are in a position of "second citizen". China has entered the WTO,and it is our obligation,as well as our promise to practise uniform citizen treatment,hence we should abolish gradually the differences between inside and outside. In addition,it lays problems of laws and rules incomplete,policy opaque,stability worse and administrative intervention overmuch in China,which increase cost and decrease attraction in foreign investment. It is necessary to settle and modify related laws,rules and policies in a full scale as soon as possible to meet the need of social economy and keep promises for joining WTO,and to work out laws,rules andpolicies openly,justly,standardly and transparently in future.Some problems existing in foreign capital treatment cannot be ignored and are waiting to be solved.
