Research On Legal Issues In The Reformation Of Systems In S.O.E.

The reformation of the systems in State Owned Enterprises is not only an economic work,but further a legal affair. Because in China,the reformation of State Owned Enterprises is being situated in a process of continual exploration and standardization,the laws and regulations about this reformation are imperfect extremely and varied while in practice,which has produced many bad effects and resulted in lots of disputes and lawsuits. From a legal angles,therefore,it is required to research on the S. O.Es' reformation and put it in a proper order.The author,as a J. M and a career lawyer,basing on the trait of her specialty and her profession,with legal principles she has mastered,analyzed the reformation of the systems of State Owned Enterprises in a frame work of the legal mechanism. It is expected that the research can provide a theoretical basis for the judicial practice,and especially can promote the scientific,unitary and standard practice of the trial.In structure,the train of thought of this article follows the order from abstract to concrete,from commonality to particularity and goes deep gradually. The first part of the article introduces some concept and historical development about the reformation of the systems in State Owned Enterprises. The second part analyzes legally the main forms of this reformation. The third part summarized the existing problems in the reformation nowadays. The last part made a detailed study of the practical problems such as the legal application,the identity of validity and the bearing of debt,which were met mostly usually in the judicial practiceand at the same time were shortened unity standard,and summed up the rules and the principles.
