| How to provide for the aged is an important subject that every country all over the world can't neglect, especially in resent years, the population's becoming aged. Many developed countries have begun to search for effective measurements to deal with the period of population aging, include England and Germany. One of the measurements is to complete the legal system of pension insurance.China is a big agricultural country with thirteen hundred million populations, therefore how to provide for the aged is an especially important subject in China's social and economic developing process. However there are many problems in the legal system of China's pension insurance, such as the amount of laws and policies is very small, the effect of laws is very low, and we don't have a unified Pension Insurance Law. All the current laws and policies are resolutions and orders promulgated by the government, which have no legal authority, and the laws are so laggard that they can't catch up with the speed of economy's development in our society. Moreover the execution of laws is very bad, which lead to a phenomena that many people and enterprises refuse to pay the pension insurance fee. All those problems form big embarrassment to the development of our pension insurance system.Reformation is urgent because of the above-mentioned problems. The proposal that establish an institution combining overall social planning with personal accounts was raised in the Notice on Reforming the system of Pension Insurance for Employees with Enterprises, which was promulgated by State Council in 1995. This proposal provides a bright object for us. In this article, the author studies on the relevant subjects about reforming the legal system of pension insurance in China and raises relevant advices.
