Study On Legal Issues Of Internet Domain Names

A variety of new problems has arisen in the process of the large-scale development of the internet,especially in domain name. Domain name was properly taken as website address. Its function has been charged with the commercialization of the internet and the prosperity of the electronic business. Containing the business honor of the enterprises domain names has become their commercial signs. Intimate correlations has emerged between the domain names and the intellectual property belonging to the type of business signs as brands and other stuffs protected by the traditional system of intellectual property .The conflicts of the rights and the legal adjustments between domain names and this type of intellectual property belonging as signs has become popular points and difficult issues.Three legal issues concerning domain name are discussed in this thesis. The first is about the strengthening of the registration and management of domain name. As the premise of obtaining the domain names,its present regulations on the system of registration and management are introduced and some suggestions are put forward according to its conditions in our country. Then the protection of intellectual property on domain name is to be established. And the protection of the domain name is the core of this thesis. By exploring its legal position and analyzing its legal traits,this thesis presents a point of view -intellectual property protection of domain name in the form of domain name rights. The third is the system of solutions of disputes of the optimized domain names. The solution of the disputes of the domain names has its sense in reality. The solution of the disputes of future domain names are predicted and foreseen legally in two ways:the executive and the judicial approach. The last part is the summery and conclusion of the suggestions,viewpoints,and prediction put forward for the three legal issues.
