Study On Improvement Of Farmland Legal System

Agricultural land nurtures the life of human being and fosters the agriculture and provides human being with various agricultural products. Given the heavy population in China, the problems concerning the agricultural land are the most prime ones which should be solved properly, otherwise the prosperity of rural areas, the stable development of agricultural economy and the welfare and the income of farmers will be seriously constrained. The further reforms of farmland management system progress, the more problems and defects of current farmland management system were revealed. Those very problems and defects restricted the agricultural economy development and impeded the consummation of rural economy system reform. Market economy demands a renovated farmland management system to match with. Furthermore, a complete farmland legal system should be constructed and improved to secure the farmland management system operating smoothly.This thesis focuses on the problems and defects of the farmland legal system construction which concern about the proprietary rights, dispose rights, transaction and administration of the current farmland management system in China, therefore, the approaches and suggestions on identifying and confirming the collective ownership body of the rural farmland, the identity body of management and operation rights on the contract farmland, structure of farmland rights, transaction sequence, expropriation and protection of farmland in farmland legal system construction were provided.
