Study On Legal Problems Of Open-end Fund

The tendency of international investment fund started from closed investment fund to open investment fund. Up to today, developed countries mostly take open investment fund. We are also going along the same tendency: starting from the closed fund in 1997, to the issuance and execution of Experimental Measures on Open Security Investment Fund by the Chinese Security Supervision Committee in October, 2000 and the birth of three open funds including "Hua An Innovation" by Huaan Investment Management Company, Open-end fund has more and more got people's favor, which has made it the mainstream of our investment fund.Comparing with closed fund, Open-end fund has its vivid characteristics and advantages. However, the functioning and development of open fund need market surroundings with right legal system. In view of the development of foreign open investment, right legal system greatly promotes it. Open-end fund have to operate under a great many regulations, and supervising system must be established and perfected to protect the benefits of investors.This dissertation demonstrates Open-end fund on the following aspects: the origin and development, the characteristics and assorting, the concerned parties and the relationship among them, the supervision, and so on. Study on Open-end fund, which is only one kind of security investment fund, helps to promote the birth of ourlnvestment Fund Law, especially the Security Investment Fund Law, and moreover helps to put forth legislation suggestions on the development and supervision of our open investment fund.
