Article no.2of the Vietnam Constitution in1992wrote:"The State of the Socialist republic of Vietnam is the State of the people, by the people and for the people, all state power belong to the people". Therefore, the people have the right to inspect, supervise agencies and individuals who represent for the people to enforce the state power, in order to prevent and restrict arbitrary and the misuse of power during the enforcement of the state power.Firstly, the essay said the general research context as following:Due to the incomplete legal system of the people’s supervision against the government, a number of government agencies and officers, civil servants misuse the power, authoritarian, harassing to the people, violating the laws very seriously leading to the pressing in the social opinion in the recent years. Along with the administrative reform promotion, the above situation has been improved in somewhat but it remains inadequate restrictions which require futher completion in which the legal improvement on the people’s supervision to the government is a quite significant content. There have been a lot of Vietnam scientific research topic on this matter so far. However, none of work mentions the people’s supervision to the government comprehensively and systematically as well as the legal improvement on those surveillance activities. This essay mainly refers the supervision of the people (direct and indirect) for the government operation through the subjects including:the socio-political organization, social organization, labor collective, press agency and direct supervision of the people.
