On The Legislative Technique Of Local Regulation

Legislative technique has produced and developed in practice. It can be called the summary of the method and skill on the defining, expressing and improving the content of law. Legislative technique is voluble to legislation and legal system, and even to development of the whole society. First, legislative technique is the certain premise and basis that can make the legislation exist and develop. Besides, it relates to the level of legal system in any country. What' s more, modern social civilization needs it.However, China is just at the first stage of research on legislative technique, and the legislative technique of local regulation falls behind the others. It is in lower level at present. The major problems are following: 1) There are blindness and passivity in defining the content of local regulation; 2)The expression of regulation' s content is lack of standard and consistency. The uncertain expression of language is considered more serious; 3) Not being good at explanation and arrangement. The first cause that leads problems is that it is affected by legislative system; another is that legislative process is not perfect; the last one is the departure from legislative directing thought.According to the developing regularity of legislative technique and the cause of problem and combining practice, we can solve the problems of legislative technique in local regulation by four: Set up a noble legislative belief, provide legislative resources reasonably, improve legislative process with proper course, and establish a standard and methodically system of legislative supervision.
