On Protection Of Procedural Rights Of Criminal Victims

With upgrade and development of movement of victims' rights and study of victims, how to strengthen and guarantee procedural rights of victims in criminal action has become a hot problem concerned by theoretical and practical circles nowadays. As for our country, Amendment of Criminal Procedure Law in 1996, although endows victims the status of a party and relative procedural rights and makes remarkable progress in legislation, from analysis of situation of six-years' enforcement of the law, victims in fact haven't the status of a party in an integrated meaning and they haven't enjoyed integrated procedural rights of a party.The article looks into situation of protection of procedural rights of criminal victims nowadays in our country, points out the distance of actual rights and ideal rights of victims, analyzes causes of defects of procedural rights of criminal victims in our country. At the same time, based on reference of experience and ways of Britain, America, Germany, France, Japan and so on, the article puts forward its own opinions about how to guarantee realization of rights of victims, how to harmonize individual interests of victims and public interests, how to realize balance of protection of defendants' rights and victims' rights, and so on, and puts forward ideas and designation of concrete operation procedure of protection of procedural rights of victims bravely.
