Study On The Crime Of Trafficking In People Of Contemporary China

The crime of trafficking in people is a serious crime that infringespersonal right and it has become a serious global problem at present.Nowadays, regarding the crime as a serious crime of infringing personalright and personality and dignity, countries all over the world hasstipulated it in criminal law with no exception. Chinese Government alwayspays attention to punishing and blowing the action of kidnapping andselling people, and by 1960s, the phenomenon of kidnapping and sellingpeople had almost disappeared in the mainland. However, with thedevelopment of society and economy, the crime revives again. Since 1970s,the crime of kidnapping and sell people in our country began to rise,especially since the 1990s, with Regional disequilibrium in economicdevelopment and the increasing gap between the rich and the poor, the numberof the crime is increasing, instead of decreasing, and the crime takes ona lot of new characteristics. The article amounts to about 37,000 words, with more than 2,400 wordsof footnote. The whole text comprises four parts: Part one: comprehensive argumentation to the crime of kidnapping andselling people. In this part, the definition and our country's legalprovisions of the crime of trafficking in people are argued; the history,current situation and characteristics of the crime in countries all overthe world are introduced; especially, the current situation andcharacteristics of the crime of contemporary China are systematicallydescribed. Part two: the essential feature of the crime in contemporary China.I pointed out: the main behavior characteristics of the crime oftrafficking in people are greedy in profit, variety of means, continuationof the behavior, specific region and hasten of time. Besides, I summed upand classified the other basic features in details from the respect of thesubject characteristics, the injured party characteristics, buyerscharacteristic, etc. Part three: systematic study on the reason for the crime occurringin contemporary China. I think traditional marriage system, feudal concept,sexual instinct of reproducing and private ownership form the form thehistorical factors; the unbalanced economic development, the lack of theconcept of the rule of the law, the reduction of prevention and control,the pushing of buyers' market and the infiltration of transnational crimescompose the realistic factors of the crime in contemporary China; criminals,victims and buyers are the individual factors. I further point out thatthe main reasons for the crime in vogue in the international society arepoor, uneven distribution of wealth, the prosperity of sex industry, lowbirth rate, huge profit, imperfect law and weak attack. Part four: countermeasures to prevent the crime of in contemporarychina. I think, measures should be taken from the respect of society, law,organization and individual. Finally, some constructive countermeasuresare put forward.
