A Legal Study On The Issues Of The Contract Of Crew's Employment

Crew is a special group in society. Shipping is a business full of risks. A close attention should be paid to the crew's legislation, because they play a significant role in the shipping business.As the basis of labor relationship, the crew's contract is very important to protect the crew's benefit. China has been a great power in the shipping industry with numerous mariners. The legislation on the crew, however, is too backward to fit for the development of the reality. In this paper, several legal issues of the Contract of Crew's Employment are studied. First, the paper explains several concepts about the Contract of Crew's Employment. Second, the paper recommends the way to find out the real party of the legal relationship of the Crew's Contract by analyzing the characteristic and the flow process of labor force. And then, the paper analyzes the content of the Crew's Contract. After that, the author discusses the problems about the conclusion, modification and the termination of the contract and the application of law. At the end of the paper, the author puts forward several legislative suggestions on the relative issues concerning the Contract of Crew's Employment in China.
