Great difficulties may be confronted in China judicial reform. The judge, who is the source of the intellect in the judicial process, should be valued in contrast to the original highlights, such as judicial procedures, judicial systems and etc. Focusing on the judges' personalities, we may find whether their personal factors have effect upon the trials or not, and their operation ways. Attribute to the function of law, the judge himself and the life, personal factors inevitably influenced the trials. These factors involve physiology, sociality and integration, which affect the psychology of the judge and rely on the ways of consciousness and unconsciousness. Through the comparative research, the acceptance to the positive roles of the judge's personal factors should be done by us, whereas their negative roles need the same attention. New roads may be found to exert the positive facet and prevent its opposite. The article' main aims are to be the contributions for correcting the traditional misunderstandings of the judge, and providing some good opinions for our judicial reform.
