The Law Problem Of The Technical Trading Measures

With the development of economic globalization and liberalization of trade, tariff is being lowered and quota, license, foreign exchange control and other non-tariff measures are in control gradually. On the other hand, the technical trading measures mainly featured with technical specifications, standards, certification system and inspection system are standing out in progress. Moreover, they have become the major trade barriers. WTO/TBT protocol and WTO/SPS protocol acknowledge the justification and necessity of those measures and permit the countries to adopt those measures in order to defend state interest and safety and health of human being, animal and plant, protect environment and keep away fraud activities and etc. However as those measures are of complicacy and invisibility, they have become the barriers to the development of trade. After China's admission to WTO, we should study how to use the favorable conditions granted to the developing countries with applicable technical trade measures to protect the domestic market and industrial development.
