Study On The Law Institution Of China Chamber Of Commerce Under The Background Of Economy Globalization

As a vital non-government organization ,the role and position of the Chamber of Commerce has attracted more and more attention and consideration .However, the development path of Chinese Chamber of Commerce is curvous and meeting setback from time to time .So strengthening the study on the law institution of Chamber of Commerce has been a priority of the agenda.The Chamber of Commerce ,as a representative of the interest group ,symbolizes the interest of the industry and commerce circle ,which can make up somewhat market and government failure due to its unique characteristic and function .And the reform of the institution of government in post-WTO China has established a solid platform ,on which the function of Chamber of Commerce can be greatly exerted.The Chamber of Commerce system and institution in the developed countries has become more and more mature and complete due to hundreds of years' development, among which that of the continent ,GB and US Chamber of Commerce and Japanese indicates different characteristics respectively .To understand and enchmark those experience will be beneficial to the development of China's Chamber of Commerce.Currently , the Chamber of Commerce in China can't play its should-be role due to a lot of problems ,which are particularly expressed as :unclear definition of its roperty , without standard management ,lacking legitimacy and some defection of organization and functions.The substantial reform of the Chamber of Commerce, which should stress on the legal characteristic, the function, and the management model , the relationship between it and the government, as well as its "de-administration" ,can't afford to wait any longer as the acceleration of economy globalization . However, such a reform should be carried out step by step under a reasonable time framework due to the complexity of the problem.And the legal framework on the construction of Chamber of Commerce is very essential to speed up such a project .Meanwhile ,such a framework should be improved and updated continuously .therefore lay a legal foundation for future Law of Chamber of Commerce.
