When research of postmodernism is undertaken, one approachable method is to commence with some main thinkers, for example, Foucault etc. In western countries, the research of Foucault is comprehensively profound, while the scholars in China have only carried out their research work in philosophical field, even though more and more scholars have come to make studies of Foucault. Furthermore, fewer scholars have performed their research work in Foucault and modern rule of law from panopticon perspective, therefore the depth of investigation is not enough.This article begins with "Discipline and Punish: the birth of prison" by Foucault, examining Foucault's deconstruction of legality of rational man, scientism and the supremacy of law and so on. In this article, the author is supposed to rethink western modern legal systems, legal conceptions, ideology and their suppression to human's rights and freedom through the analyses of Foucault's criticism of Bentham's Panopticon representing a panoramic view with the implication of economics and humanity in addition to the legal systems and conceptions supporting theory of jail. In this regard, the author hopes to arouse the spirit of a permanent criticism and awakening by all the scholars.
