Guarantee System Of Suspect's Human Rights In Our Country

The amount of the rights and the power of the guarantee system are the signal of democratization and scientific process in criminal litigation. This issue confers on western concept of human rights from the very beginning to its expanding along with the constantly changes in thoughts and theory. Making further study on characteristics of the guarantee system of suspect's human rights and its development trend, then focus on the necessity on using it for reference. Cause of the limits of the theory or something else, there are still other obvious mistakes in our guarantee system of suspect's human rights: such as lacking of rationality in establishing the authority of arrests; the rights of the suspects are still lack of protections; the suspects are still hard to acquire the help from the lawyer. Speculation in improvement the guarantee system of suspect's human rights in our country: turning the concept "focus on attacking crime" into "focus on guaranteeing the human rights"; establishing the judicatory reviewing system with Chinese character; enhancing the litigation rights of the suspect himself; improvement the helping system from the lawyer.
