Traditionally, researchers believe that the monopoly brings about the restraint of competition. Accordingly, to some extent the monopoly has become an evil in economic field. To make a response to it, the anti-trust law so-called economic constitution is established to fight against the monopoly and to maitain the order of market. However, under the circumstances the monopoly does not disappear and even a part of monopoly are approved by the law. Now a series of problems are raised: Is the monopoly completely harmful to economy and should all monopoly be disapproved ? The author thinks that monopoly includes legal and illegal part, which is not bound to bring about stagnation and degeneration. On the contrary, it is of necessity and rationality for the existence of anti-trust law.In this article, first, the author expounds that underlying theory of exemptions for anti-trust. Second, the author makes a comparison on exemptions for anti-trust among the U.S, Japan, Germany and European Common Community. Based on the, analysis, the author puts forward to his suggestions on exemptions for anti-trust.
