Research On The Third Sector For The Social Security System

A grave impediment of the legislation of the social security system is that the object mode of the social security system is not confirmed. Since the reformation of the social security system, the scholastic have deep researched many aspect of the social security system, especially in the plan of the social insurance fund, but they hardly research the organization of the social security management and service or only research the skin of it. However, I believe the kind social security system should include 2 base-point: one is the object mode of the fund mechanism, another is the object mode of the management and service organization, the research of the social security system object mode should not localized in the aspect of the fund mechanism. Base on it, I emphasize the study of the organization of the social security management and service and advance the opinion that the non-profit and non-government organization (the third sector) should be the principal part in the social security organization, I hope the point of view can redound to the disquisition of social security system's management and service organize configuration. So bear on the social security system's bankroll organization,administrative level, formality are not in the letterpress's review bound. Contrarily, the social security organization configuration, the third sector organization is considered it's importance in the social security system from the social region and social law standpoint, is researched in the context of the social development tide in the letterpress.My point of view, though the socialization of social security management and service is recognized as the object in the social security reformation, the social organization of the social security is not independent on government result on the fact that the government merged the society. Actually the social organization is regarded as the government bureau for dealing with the concrete and numerous business. The system of the social security management and service , which is different from the original administration system but same in nature and which doesn't match with the development target of the market economy of our country, can't undertake the heavy responsibility for the social security management and service. As to study the object mode of the organization of the social security management and service, I have reviewed the development history of development history Chinese social security system, and comment on the present condition of the system. Trough this, I found the essential problem of Chinese social security system is the strong trend that the organization of the social security management and service is going administrative. To look for the regular pattern and trend of the related organization of the social security management and service,I have investigated the development condition about the social security system in the west countries. I have found in the crisis and reform of the western welfare state ,the non-profit and non-government organization (the third sector),which act as the organization of the social security management and service, is taking the unreplaceable part to resolve the crisis of welfare state. Then the third sector have taken on more mission on the social security which is regarded as the government's territory .Consequently, I hold that to establish the legal system of the social security matching with modern market economy, we should reconstruct the organization of the social security management and service of our country, by the idea of the social law , under the context that the third sector has spring up and the ternary social configuration has differentiated. Moreover, we should construct the management and service organization socialized as the principal part of the social security system.
