Research On The Professionalism Of Judges

This essay consists of introduction, main text, and conclusion, and the main text has four chapters.The introduction explains in briefs the requirement of professionalism for judges on the realization of rule of law. But the conception of the professionalism of judges is still unacceptable in China. And the system of the professionalism of judges is still fulfilled. The first chapter of main text explains the reasons for the professionalism of judges. First, the authority, neutrality and impartiality of right of trial match the requirement the professionalism of judges. Secondly, the professionalism of judges is the right way to realize the independent of judicature. The independent of judicature is the main requirement to accomplish justice and reason, and the important substance is the independent of judges. The independent of judges cannot exist without the professionalism of judges. Thirdly, the professionalism of judges matches the requirement of the specialist of judicature. With the development of society, judicature becomes a special profession and the judges confront the requirement of specialist. Judges gain the knowledge and skill for the trial through the professionalism of judges. Fourthly, the professionalism of judges contributes to form the community of judges and the same way to trial issues. Fifthly, the professionalism of judges contributes to the construction of morality of judges.The second chapter of main text analyses the quality of judges. Judges should have the courage to protect justice and reason, and set up the belief of worship the law. The main duty of judges is to determine the right or false. So the important of the knowledge of law and the experience of judicature is easy to realize. The professionalism of judges often makes judges isolated from the people and it is very important for judges to have the experience of normal life. Judges also should have the intuitive knowledge to exercise the right of judicature. In order to prevent the right of judges from bad influence, judges should keep standing alone.The third chapter of main text introduces the reality of judge in our country. The process of the professionalism of judges is still uncompleted. Judge in our country cannot be standing alone and the knowledge of law cannot play a role in the judicature.The fourth chapter of main text put forward the ways to achieve the professionalism of judges. These ways conclude: to reform the system of judges and prevent the judges from the influence of regional protectionism; to improve the requirement of the enrollment of judges; to encourage the people to take an active part in the judicature; to build an opening system of judicature exam; to establish the system of protecting the profession of judges; to consummate the supervision of judges and self-administration; to strengthen the professional education and training.The conclusion briefly puts forward the important status of the professionalism of judges in the judicial reform.
