On Right To Education Of Students In Universities And Colleges And Its Guarantee System

It requires a systematical research on the issue of the right to education of students in universities and colleges, which is not only a theoretical problem but also a practical problem. Based on current research fruits, laws and regulations, research data and some cases, the thesis researches the issue from the juristic, educational and sociological perspectives. The first part addresses the definition, character and essence of the right to education of students in universities and colleges, reveals the relationship between the right and the viewpoint on students by introducing the viewpoint of students in America, Japan and China, and expounds the contents of the right to education. The second part demonstrates the theory of right fulfillment and infringement and analyses the situations of right to education in China through some data and typical cases. The third part puts forward to the system of guarantying the right to education of students in universities and colleges, which includes students independently standing up for their rights by themselves and student organizations, legislature drawing up the laws and regulations, school managing students lawfully not only in substance but also in procedure, administrative department providing necessary facilities and superintending the agenda such as schools to complying to regulations, and juridical department offering remedies when the right is infringed.
