With the development of more than 30 years, private colleges and universities have became an important part of China's advanced education, bearing the responsibility of educating for the people. Meanwhile, related laws and regulations of private education lag behind, especially many problems lie in the students' disposition system which is closely connected to students' benefit.On one hand, the scale of colleges and universities expands continuously, on the other hand, university students'law consciousness enhances, and the infringement cases that resort to the court between universities and students also occur each year, among which quite a lot of cases result from disciplinary sanction. This thesis believes that there are some problems in present students' disciplinary sanction of private colleges and universities, such as the violation of related legal principles in disposition rule-making, the deficiency of democratic procedures in disposition document-making, the suffocation of disposition remedy approach and the imperfection of subsequent education system by the means of analyzing the existing disciplinary system of Anhui Xinhua College.One of the major causes lead to these problems is the imperfection of laws and regulations which leads to the deficiency of specific basis and standard in disciplinary system of private colleges and universities. The other cause lies in college managers' unconsciousness of protecting students' rights. This thesis will discuss concrete measures of the improvement of students' disciplinary disposition system in Anhui Xinhua College from the aspects of improving related laws and regulations, normalizing private colleges and universities' disciplinary system, building students'democratic participation approach, adhering to procedure justice and improving disciplinary dissolution system, which is expected to have some enlightenment on improving the disciplinary system of private colleges and universities.The thesis can be separated into several parts as following:Chapter one is about introduction. In the introduction, it comes up with the research background, purpose and significance of disciplinary system in private colleges and universities, and it introduces the existing research status of students' disciplinary system in private colleges and universities at present.Chapter two is about related concepts and theories. First of all, it defines the private colleges and universities from three aspects:the main body of running a school, the source of funds, and the object of running a school. Then it defines the right of disposition of the private college students from four aspects, they are disposition basis, disposition purpose, disposition object and disposition consequence. After that, it illustrates the legal status of private colleges and universities, the related theory of the relationship between private colleges and students, while it emphasizes the legal relationship between private colleges and students.Chapter three is about the status quo of Students' disposition system in Private colleges and universities. This chapter mainly uses the method of empirical analysis, focusing on analyzing the existing problems in students'disposition system and implementation. The existing problems include:the query of the basis of disposition right, generalization and abusement of the principle of analogy, and the deficiency of democratic mechanism during the process of system-making. Besides, there are problems in execution:different dispositions of the same disciplinary infringement situation, obvious tendency of a heavier disciplinary action, flaws in the procedure of disposition and difficult implementation of follow-up education system.Chapter four is about the existing problems of Private colleges and universities's disciplinary system and their improvement measures. Based on the analysis of the problems in the previous chapter, it points out that there are two main reasons for the problems of the system:one is the imperfection of the relevant laws and regulations, and the other is that the managers lack the awareness of protecting students' rights. It is suggested to perfect the disposition system from the following aspects:firstly, it is necessary to separate the private colleges from the public ones so as to establish the disposition system which conforms to the nature and development law of private colleges and universities; secondly, standardize the establishment and execution of the college disposition system; adhere to the principle of procedure justice; pay attention to the establishment of follow-up education uniform and focus on analyzing how to build a disciplinary dissolution system.
