Sexual harassment in the workplace gradually becomes a tough problem, which tampers both employees and employers in China. But there is little research on this issue from the stand of the labor law except from the civil law aspect. Using as the most efficient protection for the employees, labor law cannot be a perfect measure without the prevention of the sexual harassment in the workplace. This dissertation exactly aims at the research on the sexual harassment in the workplace via the category of the Chinese labor law, including the possibility, feasibility and the concrete legal systems. The first part focuses on the academic and practical foundations of the labor law regulation on the in-job harassment. The second part talks about the essential legal questions of the sexual harassment, including the meanings and the types of the in-job harassment. The third part researches the concrete systems and procedures of labor law regulation on the sexual harassment, involving the labor contract, the liability of the employers, appealing, investigation, disposal and the evidences. The last part illuminates the deficiency of the labor law regulation on the sexual harassment in the workplace.
