Study On The System Of Government Project Procurement In China

The Government Procurement Act of China has definitely brought engineering into the scope of government procurement. And the government project procurement also has got some effects in the experimental area of China. But in China, on one hand, the development of government project procurement is limited by many reasons, for examples, the system and regulations are not sound, the theoretical research are lagging behind the practical work. So there come many problems in practice: avoiding procurement, irregular operating, surreptitious operating, and the effect of government project procurement are hard to develop. On the other hand, the internationalization of government procurement puts the double pressures of developing and opening on Chinese imperfect government project procurement. All of these urge to establish a government project procurement system with Chinese characteristics which also accords with international practice.After introducing the basic theory of government project procurement, this paper analyzes the international government project procurement regulations, the government project procurement system of developed countries and their successful practice, then, explains the features of international government project procurement, in the purpose of exploring to establish the government project procurement system with Chinese characteristics.At first, the paper introduces the government procurement and the government procurement system, explains the definite differences between government procurement and open tendering, invited tendering on the aspects of suitable subjects, purchase process, responsibility of realizing social policy target, and the nature of public law. Next, the paper introduces the connotation, features, general process, ways, procedure, and management pattern of government project procurement.In the part of concrete research, the paper attaches importance to analyze the government project procurement system of such developed countries as America, Britain and Japan, and analyze the four most influent international government project procurement regulations: the WTO "Agreement on Government Procurement", the EU "Procurement Directives", the World Bank "Procurement Guidelines", and UN "Model Law". Then it sums up the features of foreign government project procurement system and international regulations, and the inspiration to China from the both. Next, the paper carries out comparative analysis on Chinese government project procurement practice, than analyzes the problems and reasons arising produced in Chinese government project procurement practice, through the aspects of government project procurement market, default of project payment, tendering procurement, procurement procedure, and procurement institutions.In the conclusion, on the basis of analysis above, the paper put forward the suggestion of perfecting Chinese government project procurement system through the following aspects: perfect law and regulations system, setting up unified market, establishing suitable management system, improving tendering system, doing well coordinated system reforms and basic work. And at last, the paper points out the questions that need further research.
