Research For Land Tenancy Law Question Of Inner Mongolia Tumote Area In Qing-Dyansty

In this article author study land tenancy law question of inner Mongolia tumote area in qing-dynasty, and from the side of civil law history interpret the development of land tenancy law . The article mainly sue method of analysis history data and comparison. From analyzing the history of tumote area land tenancy data , author think the land tenancy law in tumote area existed mainly in form of customary law, while the relationship of state law and customary law was mutual syncretism and conflict. The land tenancy customary law of tumote area in qing-dynasty had developed plentiful prescription. In qing-dynasty, state law which regulate inner Mongolia tumote area land tenancy law question was not fitted the area's practicality, which could not satisfy the area's land tenancy law demand. This offered amplify space for customary law. Whit settling land tenancy law question , the customary law brought some special law phenomena that representation was yongzu. But the customary law hadn't been systematize, for lacking of state law's guidance and private law consciousness. Of the land tenancy law question , therelationship between state law and customary law was mutual syncretism and conflict, but the conflict wasn't severity ,while the state law recognized customary law in some degree. From land tenancy law analysis of tumote area in qing-dynasty, this article from the side of law explain change of Mongolia area community relationship in qing-dynasty and the law figuring the area community relationship from status tocontract.
