Study On Land Tenancy Contract In Qing Dynasty

The land tenancy contract transaction in Qing Dynasty was a complex transaction process,which was affected by the personal economy,but also by the relevant factors such as national laws,local customs and so on.This article takes the land tenancy contract as the research object,through the interpretation of the contract documents,finds out some trading habits,and clarifies the relevant regulations of the law of the Qing Dynasty on the tenancy contract,in order to observe the overall operation of the tenancy contract.The article is divided into five parts in structure to study the tenancy contract in Qing Dynasty.The first chapter is an introduction,which is divided into four parts.The significance of topic selection,literature review,research contents and methods,and innovative points of the article.In order to fill in some gaps in this field,this paper mainly uses the overview method to analyze the specific status of previous studies.The second chapter mainly introduces the conclusion of the land tenancy contract,which is divided into two sections.The first section is the form of the tenancy contract,which consists of the contract head,the contract middle and the contract tail.The second section mainly describes the form of agreement between the two parties,including oral contract and written contract.Chapter ? and Chapter ? mainly introduce the basic elements of land tenancy contract,which is divided into two parts.The content of land tenancy contract is mainly from the parties,subject matter,land rent,tenancy period,rights and obligations of both parties,breach of contract to analyze the elements of the elements of the establishment,as well as the legal regulation of the relevant elements in Qing Dynasty law.The fifth chapter mainly investigates the tenancy contract in Qing Dynasty,which mainly includes three aspects: first,the value of the land tenancy contract in Qing Dynasty,second,the role of the land tenancy contract in social development in Qing Dynasty,and third,the Enlightenment of the permanent tenancy phenomenon to the land reform in China today.According to the interpretation of the tenancy contract and the analysis of the first three chapters of the article,the article is sublimated,and then a summary of the article is made.This article takes the land tenancy contract in Qing Dynasty as the research object,and through the analysis of the contract elements and related contents,we can have a comprehensive understanding of the tenancy contract.It also combines with the legal system of the Qing Dynasty to restore some objective phenomena in the land tenancy transactions of the Qing Dynasty.
