Study Of The Protection Of The Investors Of Securities Investment Fund

The combination of the ancient trust system and the modern financial market created the securities investment fund, which claims the advantages of the congregated capital, combined investment, shared risk, and professional financial management. Due to its origin in British-American law system, the securities investment fund aroused various conflicts with the existing systems of the continental law system and left many problems to be solved to the continental laws practicing countries in their introduction and transplantation of the fund. The most urgent issue is the definition of the juristic relations between the parties concerned and the options of the establishment of the relations directly determines the investors' status and rights granted, who are the grass-root participants in the fund and whose trust in the fund market is the foundation of and prerequisite for the existence and development of securities investment fund. Although our country's Securities Investment Fund Law aims at the protection of the investors' rights, its efficient materialization depends on the feasible system and regulations.Therefore, in this paper the author focuses on the protection of the rights of the securities investment fund investors and extends the research into the definition of the juristic relations between the parties concerned, the investors' rights and their protection measures and salvation, etc.
