A Research In Theory And Practice Of The System Of Lawyer Of Public Office In China

Public office lawyers are lawyers having obtained practicing certificate and exercise state power in accordance with the law who offer law service to public affairs. Setting up the lawyer of public office system in our country is in need of moving forward the legal system reforming of our country and promoting the desirability of administering the state according to law, in need of the development of socialist market economic after our country obtained the accession to the WTO. Establishing this system will develop and perfect the lawyer system of our country. It is also an important sign of our legislation being in line with international standards. The change of the legal system is not simply compiling of the code. The more important thing is the gradual progress of the society and transition of people' s idea. So in the process of setting up this new system we should fully give play to the role of educational work of ideology and politics. The establishment of this new system will surely put forward new subjects for the ideological and political work and offer new opportunity for the combination of running the country according to law with running the country with morality. This thesis firstly carry on the discussion on running the country according to law and the new development of the ideological and political work. And expound the necessity of setting up this system. Then systematically explained the content of lawyer' s system of public office such as basic conception , characteristic , business scope ,etc. And then explain my view of lawyer current situation and the setting-up of relevant institutional improvement and the development trend in the future of this system, combined with the comparative research on the lawyer system of other country and the practical experience of several city of China.
