The Perspective And Reform On The System Of Civil Legal Expense In China

As an important part of civil procedure system, the system of civil legal expense has its independent status and functions, and it is an important system that concerning the extent of nationals to approach administration of justice as well as the strength of guaranteeing trial resources, and finally relevant to the shaping and development of safeguard mechanism for the whole society. Therefore, the research on it has important significance in theory and practice. Taking a classic grass-roots court in a poor district for object, I inspected by evidence overall for the present running situation of legal expense system and actual situation of attainment and assignment of trial resources, and specifically revealed the two predicaments that the phenomenon of "charges in disorder" is serious and trial resources are so insufficient faced by grass-roots courts, and discussed the defects in system from these predicaments in perspective, then pointed out the basic theories and proper ways of reform for legal expense system in our country. So I considered that the reform of legal expense system should based on the state of our country, and fully concern two factors of ensuring parties to perform the right of action abundantly and making sure the trial functions of courts can be elaborated fully, so it can be cooperated with financial system's reform, and then get into the positive operating process of perfecting each other and coordinating each other in systems, so that the reform can get the predictive effect.
