Research On The Property Right Market Regulation Law

Aimed at the problem of the property right market, the author firmly believed that it is very necessary to improve the regulation to the property right market. This paper is arranged to analyze the regulation on the property right market systemically and try to design the law about it. The paper is consisted of introduction and other four chapters, its structure and main contents are as follows: In introduction of the paper, the author defined a group of definitions,introduced the research methods, the logical clue and the research framework of this paper. Chapter 1 discusses the character and dysfunction of the property right market. Only make the character clear, can we have the target to design the regulation law. The writer personally believed that the property right market is a comprehensive market which major character is capital market. Target to the dysfunction and the tendency of innovation and development, the writer believe it is important to supervise the property right market. Chapter 2 focuses on the economic analysis about the property right market. The Public Interest Theory is the basic theory of the regulation to the property right market. Using the Theory of Game we can get a result that there are the government failures in regulation. Analyzing the cost and the income of regulation, we can get a result that the regulation is not unlimited, the regulation should be moderate. Chapter 3 deals with the analysis of law. The writer believes that the property right regulation law belongs to the economic law in nature. It bases on the public interest, balances the right of each sides. Economic order, interests of the whole society and substantive justness are its major values. Chapter 4 concentrates on the building of the property right regulation law. The writer tried to design the property right regulation law systematically.
