Researches On The Legislation Of "He-hui" In China

"He-hui", as a proper phenomenon of orient society, is a giff-gaffed and cooperate organization that based on the relations of zone and kin. It is the outcome of history, originate from the country culture, and offers advantageous conditions to the developing of country. Since the new China was founded, "He-hui" was forbidden because there were great risks such as dismiss of "He-hui". But it is exist still all around China, today. There are lots of "He-hui" in some areas, but they are nonlicet. "He-hui" become into legitimate in "Tai-wan", since the May of 2000. How can we do about "He-hui" in China? Does it should be protected by the law? The author has done some researches on the legislation of "He-hui" in China. The article is compose of introduction, straight matter and finality, and the straight matter include four chapters:At the beginning, the author introduced the elementary factors of "He-hui", such as concept, characters , qualities in the law, the disposal principles about irregularity in China, and so on. Secondly, he has analyzed the history of "He-hui", and compared the different history and actuality of "He-hui" in "Tai-wan" and China. Thirdly, he believes that legislation of "He-hui" in China is necessary and feasible. The necessity is based on four factors, and the feasibility is based on three factors. In this chapter, the author has assayed and gainsaid the main reason of those people who against the legislation of "He-hui" in China. In the fourth chapter, he put forward his advices about how to legislate. The author think that a law system should be build to keep the great risk away.
