Studies On Problems And Countermeasures Of Selling Land Using Right By Auction In China

Since M.L.R (the Ministry of Land and Resource) Order No.11 was issued, auction has become one of the main means by which the right to use state-owned land is remised in China. However, the means of auction applied to remise land is not perfect and still to be improved. Some illegal and crack-barrel behavior that happens during the auction of land has severely tampered with the further development of the land employment system.On the basis of analyzing the current conditions of the land auction all over the country, the thesis builds model to evaluate the efficiency of the state-owned land auction in China with the comprehensive fuzzy appraisal method, and probes into the problems of the auction system. As a result of the analysis, the main problems are attributed to the practitioners' ability and the environment of land market. In order to settle the problems, the author builds chess-playing model and makes comprehensive evaluation by the means of both qualitative and quantitative analysis. These conclusions are drawn based on the modeling and evaluating: it is propitious to decrease the possibility of collusion behavior among the contesters through determining a reasonable land reserving price, increasing the auction bail and the auction contesters; the possibility of the collusion behavior by land administrative officials and auction contesters and the cost of collusion are of inverse ration; it is helpful to prevent the officials' collective corruption behavior by the means of establishing the system to inspire supervisors and increasing the psychological cost of supervisors' collusion; it is advantageous for the land market to develop healthily by building model to evaluate the auction feasibility of the land use right in order to control the land auction in advance.
