Study On China Land Reservation System Law

China's land reserve system created in the nineties of last century, the Government has to regulate the land market, land management and strengthen macro-control capacity of the introduction of a new type of urban land management system. Land reserve system has become China's land market and land management in a hot, but because of China's land reserve system is still in the initial and exploratory stage, the specific operation of the process also needs to explore and improve the range of issues.2007 Ministry of Land Resources, Ministry of Finance, Bank of China jointly issued on the "land reserve management," the notice, the first released national land reserve regulations, work and research of land reserves in the new historical stage.In this paper, the status of China's land reserve, summed up across the country to carry out a land bank of practical work experience to draw on the advantages of foreign land reserve system, on China's land reserve system for reflection and ideas. First of all, this land reserve system on the basis of in-depth theoretical exploration, the use of economics, management, environmental protection, integration of theory with each other, focusing on the theory of land evaluation and land reserve system was the construction of correlation analysis. Secondly, the relevant laws on land reserves, policy research, provide the basis for the land bank and legal support, the land reserve system that established the principle of the new legislation, and the promulgation of national land bank law legislative proposals. Finally, the process for the land bank financing, sector management issues, the price of compensation for land reserve and land reserves, scale of analysis of the problem, the land reserve system for the rationalization of supporting the proposal.
