The Study On Financial Leasing Market Access Supervision Of China

Finance lease originated from the United States in 1950s and was adopted by a lot of countries. Now, it has already become one of the largest financing patterns second only to bank credits. The type of financial leasing operation was introduced to China in 1980s, but its future development is still far from being satisfactory, because financial leasing isn't really brought into play an active role on the national economy. One important reason is that the improper financial leasing market access supervision impedes the development of finance lease in China. This thesis makes some good proposals based upon the analysis of the status quo of the financial leasing market access supervision in China and aims to improve it.This thesis adheres to the following main theme:To start with the introduction, it introduces the background of the topic selection and the research status quo on domestic and overseas. Then, it defines some key concepts such as finance lease, financial leasing market access, financial leasing market access supervision, and so on.The body of the thesis firstly explores the theoretical foundations of the financial leasing market access supervision in China and briefly introduces two foundational theories on the market access------the market failure theory and the theory of the appropriate intervention by government. Secondly it analyzes the special roots of the Chinese financing leasing market access supervision. On this basis, it advances the aims of which should be achieved in the financial leasing market access supervision in China. And then it reviews the evolution of the financial leasing market access supervision in China and summarizes the characteristics of the financial leasing market access supervision in China.This thesis focuses on chapter 3 and 4.Chapter 3 firstly analyzes the status quo of the Chinese financial leasing market access supervision from four aspects: the status quo of the legislation, the license entity, the license form, the conditions of access and the scope of business. Furthermore, this thesis and puts forward some questions existing in the financial leasing market access supervision in China, such as the duplication of approval, the different qualifications between domestic-funded and foreign-funded on market access, the excessive demands on capital, the weak management on the employees'professional qualifications, and so on. The ambiguities of the finance lease nature and the indistinct Orientation of government functions are to blame for many of those problems. Chapter 4 advances some proposals which could improve the financial leasing market access supervision in China. As regards the patterns of market access supervision, it analyzes three patterns of the financial leasing market access supervision abroad and the factors in selecting a pattern. Then based on China's realities, the pattern of moderate supervision is advised to adopt. As regards the license authority, probing into the other countries'practice, the reason can be found that those countries adopted the different methods on the market access supervision is theirs different ideas on the nature of the finance lease. Based on the judgment of the nature of the finance lease, this thesis puts forward some improving proposals, including: identifying the administrative department for industry and commerce as the license authority of the finance leasing companies and giving the bank committee the power to approve the financial business of finance lease companies. As regards the conditions of market access, this thesis also puts forward some recommended suggestions, such as: to unify the standards concerned the domestic-funded or foreign-funded on market access, to reduce the threshold on market access and to build a management system of the employees'professional qualifications in the finance lease.
