Study On Legal System Of Supervision Of Financial Leasing

Regulatory system is one of four pillars of development of leasing industry.Recent years have witnessed significant development of financial leasing in ourcountry, however, the Regulatory system has not been adjusted or improvedsynchronously, which has constrained and hampered the healthy development offinancial leasing industry. The essay aimed at combing the concept and property offinancial leasing and analyzing the counterpart of foreign countries, and then pointedout the shortcomings and the cause of our regulatory system. The essay also gavesome suggestion on the regime of regulatory law, combining with economic situationat home and abroad. This essay consisted of three parts, the preface, the main contextand the conclusion. The main context consisted of four chapters.Chapter one is a brief analysis on the basic theory and the necessity of regulatoryof financial leasing. This part gave a theoretical analysis on the concept of financialleasing, the connection and difference between financial leasing and some relevantconcept and the character of financial leasing. It also deep analyzed the necessity ofregulatory by interpreting the dual characters.Chapter two is about the regulatory pattern of foreign financial leasing and itscomment. This chapter aimed at giving several useful suggestions on our regime ofregulatory law by introducing and analyzing foreign regulatory law regime onfinancial leasing, especially from some representative countries such as America,Japan, Germany and Korea.Chapter three is about the observation of our regime of regulatory law offinancial leasing. This chapter mainly analyzed the history and present, existingproblem and cause of our regulatory system, trying to find out the solution of currentchallenge of financial leasing regulatory.Chapter four gave several suggestions on perfecting our regime of regulatory lawof financial leasing. This chapter gave specific suggestions on how to construct andperfect our regime of regulatory law of financial leasing, from aspects such as thechoice of regulatory model, regulatory principle, regulatory power, regulatory regimeand related auxiliary system.
