Migration Freedom Related To Household Registration

Migration freedom is the basic right of human being. But the migration freedom has been forbidden for many years because of the planned economy system. Stipulating the migration freedom in the Constitution is the need of the social market economy and the morden democracy. It is the target of the household registration reform to abolish the distinction between farmers and city dwellers,to found unified household system and to realize the migration freedom .We must produceconditions to realize the migration freedom through household registration reform. This dissertation explores this issue in depth and width in five parts.The first part starts with a discussion on human rights world conventions and makes this a keynote for later discussions, that is, to admit and protect the freedom of migcatrion is a request and tendency for China's further development. In the mean while, the actor also analyses the values of the freedom in politics and economics in China.The second chapter mainly deals with the concept of the freedom of migiation. The author concludes that the freeedom of migration refers to the freedom for citizen to leave former residence and arrive at place to live, without any illegal restriction. There are four causesthat this right should be granted: a) it is from the innate requirement of humanity and its development;b) it with the legibility of political governess; c) it is a demand from the development of market economy; d)it is reflect the value of law.The third chapter discusses the formation of household registration system. It began in Shang and Zhou Dynasty, matured in Tang and Song Dynasty, and in Tsing Dynasty, it fossilized into an institution prohibits the people from theft house. After the foundation of People's Republic of China, the freedom of migraton was once recognized, but with the establishment of a serious of rules and policion, and the Constitutions of 1976, 1978, an 1982 all neglected this freedom. The household registration system finally became a great abstacle to Chinese civilian movement again.The fourth chapter makes a survey over the related rights like the right of election, education, labor,social security. The last section proposes the author's own design: We must makesureof the resident's identification and recall the original function of the household register system for human resource statistics and effective social domination. And make a transition from household register system to population management. To achieve freedom of migration step by stey, and at the same time, carry out the reformation of social security system, and education system.
