On Migration To The Necessity Of Liberty In The Constitution And Its Implementation

The freedom of migration can be classed into freedom of migration in broad sense and narrow sense. This thesis uses freedom of migration in narrow sense, and seeks to the best way to realize freedom of migration in China, through investigation the reason and negative effect about cancellation freedom of migration in Chinese constitution, and discusses the necessity and the practicability to revival freedom of migration in Chinese constitution. This thesis consists of four parts. The first part is the basic interpretation of freedom of migration. First, discusses the concept of freedom of migration. Second, argues the quality of freedom of migration. It belongs to the scope of personal liberty and related to the social and economic right and political right closely. Then discusses the regulation and experience of freedom of migration in other country. Then argues the evolution of freedom of migration in China.The second part is the reason and negative effect about cancellation freedom of migration in Chinese constitution. Mainly analyse the historical reason social and economic reason and conceptual reason about cancellation freedom of migration in China in that time and the negative effect of this policy,,The third part is the necessity and the practicability to revival freedom of migration in Chinese constitution. Through argues the significance of revival freedom of migration and the qualified condition that realize freedom of migration in China. Then draw a conclusion that China should revival freedom of migration.The fourth part is the thinking about the realization of freedom of migration in China. First, discusses the principles should be 'followed to realize freedom of migration. Then argues the primary assumptions about the realization of freedom of migration in China.
